Climate Lawsuits Heading for Defeat Say Top Legal Experts

Desperate greens file countless lawsuits in last gasp bid for climate regulations: experts, public and lawmakers unmoved.

May 2011 sees the Big Green litigation machine go into overdrive as it ignores Gallup Poll ratings showing Joe Public no longer believes it’s global warming propaganda. In a story that is going viral on the web, Matthew Brown (Associated Press) explains that, “The courtroom ploy was backed by activists looking for a legal soft spot to advance a cause that has stumbled in the face of stiff congressional opposition.”

In the United States environmentalists plummet new depths as gullible children are groomed to appear in courts to explore any legal loophole to squeeze through impose swinging climate regulations damaging to economic recovery. Meanwhile in Canada skeptic climatologist, Dr. Tim Ball rides a tide of popular support to fight back against well-funded climate doomsayer libel suits.

Greens Groom Kids with Crank Claims of Carbon Contamination

Matthew Brown’s report highlights how the idealism of children is cynically being exploited with this spate of lawsuits. Alec Loorz of Ventura, California, is one of many children indoctrinated into thinking our planet is doomed.

An Oregon-based nonprofit called Our Children’s Trust has been recruiting kids like Alec Loorz as plaintiffs for their speculative claims which are based on “common law” theories, not statutes adopted by state or federal lawmakers.

Loorz is an impressionable 16-year-old climate activist groomed as a plaintiff in one of the speculative U.S. cases. A worried Loorz said he latched onto the effort because he thought, “it would give us teeth, give us a bigger voice than just yelling and marching.”

Loorz was first groomed as an ‘eco-warrior’ at the tender age of 13 after seeing former Vice President Al Gore’s discredited movie, ‘Inconvenient Truth.’ A British High Court ruling in 2007 was that Gore’s film contained nine lies.The judge ruled that the film can only be shown to children with guidance notes to prevent political indoctrination. Sadly, Loorz’s green groomers omitted to pass on that vital piece of information.
Thus the deep-pockets of environmental ‘charities’ believed to be funding young activists, are still remorselessly insisting that human emissions of carbon dioxide that comprises less than 0.04 percent of the atmosphere, is a dangerous ‘poison.’ But to biologists the benign trace gas is merely plant food and has long been pumped into Loorz’s sodas to give that bubbly fizz.

Lawmakers Condemn Green’s Misuse of Precious Court Time

Many legal analysts predict that this latest ruse by climate extremists will clog up the court system in all 50 U.S. states. Such lawsuits are already being frowned upon from an unlikely quarter: the Obama administration.

Already, the U.S. Supreme Court has disapproved of such “nuisance cases.” Environmental lawyer, Steven G. Jones correctly echoed the voice of the judiciary, “[t]he Supreme Court has long recognized that there are cases that raise political questions that should be reserved for the political branches of government.” [1.]

In his excellent legal analysis, ‘Republican Lawmakers Join Obama Administration in Urging Supreme Court to Overrule GHG Nuisance Case,’ Jones highlights the fact that the Obama administration agreed with Republicans that the U.S. Supreme Court was correct to overturn an appellate ruling that would have allowed environmental plaintiffs to sue sources of greenhouse gases (GHGs) under tort law. Thus even this ultra-green President who tried and failed to get Congress to pass climate laws frowns upon this new and ill-thought out legal gambit.
Harvard Law School professor Jody Freeman agrees with Columbia University law professor Michael Gerrard are among a host of experts advising that these frivolous lawsuits won’t save a moribund green cause. Freeman doubts a law court could ever be an appropriate forum for the issue.

“I am generally skeptical the plaintiffs will succeed in the courts pressing for common-law remedies from judges,” Freeman said. Another expert, Hans von Spakovsky, attorney and a former member of the Federal Election Commission (FEC), dismissed the lawsuits for being based on “a creative, made-up legal theory.”

However, to the far northwest in Vancouver, British Columbia, a far more compelling and ultimately decisive global warming legal battle is being fought in Canadian libel courts. Climatologist, Dr. Tim Ball and his legal team are confident they will deal their own fatal blow to two lawsuits filed by UN climate extremists, thus putting an end to any claims that man-made global warming has any scientific substance.

The omens are good, according to ‘Time’ magazine, which notes that Canadian voters, just like their U.S. cousins, have been voting down green policies in recent elections; so it will be hard to find any jury north or south of the 49th parallel eager to resurrect environmentalism’s lost cause.

$5 Billion Peed Away on Weatherizing Program

Flush those tax-dollars down!

Here’s more money peed away by the Obama Administration who evidently strive to live up to the statement “There’s a sucker born every minute.”

Per Fox News we find  out how more of your hard-earned tax-dollars are being flushed because no one’s watching what’s going on…….

President Obama’s $5 billion stimulus injection into a decades-old program to help lower energy bills for millions of low-income families by retrofitting their homes to improve efficiency has been plagued by cases of mismanagement, waste and fraud in several states.

So how bad is it?

“It’s a complete cesspool of waste,” Leslie Paige, vice president of Citizens Against Government Waste, told “When it’s over, we will never know how much went down the tube. They cannot track the money. By the time they get to it, a lot of the money will be gone.”

Well, I have to wonder how much of this ended up in those good buddies of the Obama Administration like Democratic contributors and unions? The way their accounting works, no one will probably ever know and no one will probably ever get in trouble over it.

$8 Billion on Clean Energy Tech?

You can see from the above poll at Fox that people aren’t very happy about Obama wanting to waste spend $8 billion dollars on clean energy technology. I am not a mind-reader but you can bet your bippy that a lot of this will probably end up as grants to pay off his political buddies like Solyndra. At the time the screenshot was taken 87.28% were against it.

Satellitegate – The saga continues


Like the Ark of the Covenant in Raiders of the Lost Ark, it appears the government warehouses satellites, too.


We have items on here about satellites that don’t work properly and satellites that have been destroyed during launch that you can read about here, here, here, here, here, here, here, here and here.

While I am not a big conspiracy person, I don’t see why I can’t wonder just what is going on with all of this and who or what is behind these problems?

Is it a conspiracy? Stupidity? Vanity? Someone upstairs quashing things? Inter-agency arguing? All of the aforementioned? Sheer coincidence? I can’t really say with any certainty one way or the other, but with all the goings on, I do feel perfectly justified in asking questions, as do others.

What are they hiding, if anything? Are the warmers afraid these new satellites will disprove all their global warming theories? Are the denialists afraid the satellites will prove that the warmers are correct and we do indeed have global warming? Is the government hiding something from us? I ask that last one because the article does mention that the USAF is interested on how solar rays affect their equipment. What equipment? HAARP? Something else we don’t know about?

Too over the top? Well maybe yes, maybe no. It may be something no one will ever know, or not find out for a hundred years. JFK was assassinated in 1963 and no one’s even seen what the whole deal was with that and we may never be privy to that information.

For those who are interested in this, Popsci has a very enlightening article today titled “Who Killed the Deep Space Climate Observatory, which was originally proposed by Al Gore in 1998 and then killed right after George W. Bush was elected.

In what sounds like the end to the Indiana Jones Movie, Raiders of the Lost Ark…….

Nearly a decade ago, NASA built an Earth-monitoring satellite that could have observed global warming in action. Then the agency stashed it in a warehouse in Maryland, where it remains to this day.

It’s an excellent article that will open your eyes to some of the CO2 Insanity that goes on behind the scenes at NASA, NOAA and the White House.  I, for one, would like to know why we have a very expensive piece of equipment ($100 million of your tax dollars) sitting in a warehouse for almost a decade that will shed some more light upon the global warming theory, regardless the outcome.

CARB: Killing jobs in California

This is an interesting video about the shenanigans that go on at CARB under the liberal guise of protecting us, which should be better known by most as fraud. Watch how they are destroying the California economy and killing jobs. I can’t wait until there are no taxpayers left after everyone flees over-regulated and over-taxed California for other states or countries.

Gore denounces global warming!

Today Al Gore denounced global warming. In an apology speech he said……….

Global warming is a fraud and I am ashamed of being conned into believing it!

I have immediately cancelled my order for the new Fisker’s Karma electric car and I have ordered a new Hummer to replace it. The Hummer will have a twin-turbocharged 454 Chevy engine in is that bored out to 515 cubic inches, makes 950 HP and gets 1.2 miles per gallon.

Since being green is no longer a problem with global warming and the drought in California is over I have ordered high-flush toilets for the 9 bathrooms in my new Mansion in Montecito, California. I have also added 3 more heaters and 3 more air conditioning units, the latter of which will be great for cooling me off when I have a hot masseuse over.

Tomorrow I will start writing my new book about global cooling titled “An inconvenient deep freeze,” which will suggest that we start burning more stuff to create more CO2 so we can start warming this planet up before we all freeze to death!

I am also suggesting to President Obama that we immediately start to drill baby drill all over the place. ANWAR? No problem! Deep drilling in the Gulf of Mexico! Go for it! Hell, I’m even going to make sure that off-shore drilling around Santa Barbara is approved again! I can’t wait for the view of all those drilling platforms!

And………if you believe this….. I have a nice bridge that is golden in color that goes from San Francisco, California to Marin County, California and will be accepting bids starting at the minimum bid price of $100 billion.

California’s Drought is Over-done-finito

Finally the greentards in Sacramento have awoken! It’s official! According to the San Jose Mercury News the California Drought will be officially over when Governor Jerry Brown announces it tomorrow!

We have areas in the Sierras that have over 50 feet of snow and the reservoirs are filling up fast with a total group average of 115% of normal and the snow-melt hasn’t even started yet.

So next time a greentard tells you there’s a drought in California, or a warmer tells you that there’s a drought in California because of global warming-climate change – climate disruption or whatever lame excuse they have –  tell  him or her to stick it up their aquifer – sideways!

Why can’t Caltrans do this?

Remember the Loma Prieta Earthquake in California in 1989? Remember that year, it’s important. The San Francisco Bay Area has languished for over 2 decades now and the new section of the San Francisco-Oakland Bay Bridge is STILL not completed. As of now it’s over a decade overdue and $4 billion over budget and not anticipated to open until sometime in 2014. The construction didn’t even start until 2007, which is 18 years after the earthquake.

Remember the collapse of the Cypress section of the Nimitz Freeway in Oakland? I do, I went down there the day after the earthquake. Seeing it on TV was bad, actually going down there and looking at how this massive concrete structure was torn to shreds was a very humbling experience. I’m certainly glad I wasn’t driving on it when the quake hit. If I was I might not be writing this. Forty-two people were killed on this section of the freeway when it collapsed.

That was an amazing experience on how slow things work in this state, too. This took 9 years to build and wasn’t completed until July, 2007, a ‘mere’ 18 years after the quake at a cost of $1.2 billiion.

So, what happens in Japan with their roads that were destroyed in the recent 9.0 earthquake? Well, it seems they move a lot faster there than we would even think possible with all the BS in California that goes on. You can see the before and after of the road in the photo below.

6 Days to repair this. Caltrans probably would have been at least 6 months

So how long did this take? Well obviously it wasn’t decades or years or even months. It took the Japanese a mere 6 days to repair this section of the road. There were no arguments, no messing around, no lawsuits by the greentards, nope they just hauled ass and fixed it.

My suggestion for Governor Brown is to eliminate  Caltrans and hire the Japanese to fix our roads and bridges. I’d imagine if we’d contracted with them in 1989 the Cypress Section of the Nimitz Freeway and the new Western span of the San Francisco-Oakland Bay Bridge would have been completed over a decade ago and at significantly lower cost.

There’s an old joke about Caltrans that I find amusing……

A lady rushes into the local police station and the Desk Sargent asked “What can I do for you maam?”

The lady says “I was just raped by a Caltrans worker and I want to report it!”

The Desk Sargent asked “How do you know he was a Caltrans worker? Did he have his hard hat on with the Caltrans Logo?”

“No” she says, “but I know he was a Caltrans worker.”

The Desk Sargent asked “Well, did he have his orange Caltrans vest on lady? Is that how you know?”

“No” she says “but I now he was a Caltrans worker.”

The Desk Sargent is now flustered and blurts out “Well lady! If he didn’t have any Caltrans clothes on then how in the hell do you know he was a Caltrans worker?”

She says “Because I had to do all the work!”
